1. Agreement to Terms & Eligibility

These Terms of Use, including this End User License Agreement ("EULA", "Terms"), constitute a legally binding agreement between you ("User", "you") and gUmsIz ("we", "us", "our") concerning your download, installation, and use of our mobile applications, including Flea Markets (Flohmärkte), Verben, Word Puzzle, Batak, and DerDieDas Universe (collectively, the "Apps" or "Services").

By downloading, installing, accessing, or using any of our Apps, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately uninstall and discontinue use of the Apps.

2. License Grant & Permitted Use

Subject to your compliance with these Terms, gUmsIz grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and execute the Apps on any compatible mobile device (Apple iOS, iPadOS, or Google Android) that you own or control, solely for your personal, non-commercial use.

You agree NOT to:

  • Decompile, reverse engineer, disassemble, or attempt to derive source code from the Apps.
  • Modify, translate, adapt, or create derivative works of the Apps or their assets.
  • Distribute, rent, lease, sublicense, loan, or commercially exploit the Apps.
  • Bypass or disable any digital rights management or security mechanisms implemented in the Apps.
  • Use cheats, automation scripts, bots, hacks, or unauthorized third-party software.

3. In-App Purchases & Auto-Renewable Subscriptions

Certain features, levels, ad-free modes, or content packages within our Apps may be offered as In-App Purchases ("IAP") or auto-renewable subscriptions. By initiating an in-app transaction, you acknowledge and agree to the following terms:

A. Billing and Payment Processing

All transactions are processed through the respective digital storefront where you obtained the App: the Apple App Store (via your Apple ID account) for iOS devices, or Google Play (via your Google account) for Android devices. Payment is charged to your account at the time of purchase confirmation.

B. Auto-Renewal Terms

Subscriptions automatically renew at the end of each billing cycle (e.g., monthly or annually) unless you turn off auto-renewal at least 24 hours prior to the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current subscription cycle at the regular rate disclosed at purchase.

C. How to Cancel Subscriptions

You can manage or cancel your auto-renewable subscription at any time directly through your device settings or app store account. Uninstalling the app does NOT automatically cancel your active subscription.

On Apple iOS Devices:
  1. Open the Settings app on your iPhone or iPad.
  2. Tap your Name at the top of the screen.
  3. Tap "Subscriptions".
  4. Select the gUmsIz App subscription you wish to manage.
  5. Tap "Cancel Subscription".
On Google Android Devices:
  1. Open the Google Play Store app.
  2. Tap your profile icon at the top right corner.
  3. Tap "Payments & subscriptions" and then "Subscriptions".
  4. Select the gUmsIz App subscription.
  5. Tap "Cancel subscription" and follow the on-screen prompts.

D. Free Trials

If a free trial period is offered, you will be billed after the trial period ends unless cancelled before the trial expires. Any unused portion of a free trial period is forfeited when you purchase a subscription to that publication or feature, where applicable.

E. Refunds and Entitlement Verification

All purchases and refunds are governed strictly by the refund policies of Apple and Google. Because transactions are billed directly by the platform, refund requests must be submitted directly to Apple (via reportaproblem.apple.com) or Google Play (via Google Play Help). Purchase entitlements are validated securely using Adapty and platform receipt verification.

4. User Content & Feedback

If you submit feedback, suggestions, reviews, bug reports, or community market suggestions (e.g., within the Flea Markets app), you grant gUmsIz an unrestricted, worldwide, perpetual, royalty-free license to use, publish, and incorporate such feedback into our products without any compensation or obligation to you.

5. Intellectual Property Rights

The Apps, including but not limited to software code, graphics, audio, UI layouts, animations, visual designs, and the "gUmsIz" trademark and logos, are the exclusive property of gUmsIz and are protected by international copyright, trademark, and intellectual property laws. All rights not expressly granted to you are reserved.

6. Disclaimer of Warranties

THE APPS AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APPS WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GUMSIZ OR ITS CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APPS.

8. Termination

We reserve the right, in our sole discretion and without liability, to suspend, restrict, or terminate your access to the Apps or any portion thereof at any time for any reason, including violation of these Terms.

9. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms or the Apps shall be instituted exclusively in the competent courts of Germany, subject to mandatory consumer protection laws in your jurisdiction.

10. Modifications to These Terms

We may modify these Terms at any time to comply with changes in legal requirements or App functionality. The updated version will be posted on this page with an amended "Last Updated" date. Continued use of the Apps following such changes constitutes your acceptance of the revised Terms.
